Taxpayers missing the July 31 deadline still have legal recourse. Here is a step by step on deadlines, penalty and limits for belated and updated ITRs.

With the deadline of Income Tax Returns by July 31 over, anyone who has failed to file the returns has already missed the primary filing window. But the tax laws don’t leave you without options if you have already missed this date. You have two different back-up routes: a late return and an amended return.

First escape hatch: file a late return by December 31

If you don’t file by the July 31 deadline, the next best thing is to file a belated return. This return is due December 31 for eligible taxpayers, but there is a cost under Section 234F of the Income-tax Act. For those earning up to Rs 5 lakh, the penalty for late filing will be a maximum of Rs 1,000. For those earning more than Rs 5 lakh, the fee can be up to Rs 5,000. Also, if you have any tax dues, an interest under Section 234A will be charged on the dues along with the penalty for the delayed payment.

Edit Your Late Return Flexibility to Correct Mistakes

One big advantage of a late return is that it’s flexible. A belated return can be revised if you find mistakes or omissions after filing it, filed under Section 139(4) – a rule that has been applicable since Assessment Year 2017-18. Any taxpayer can correct any mistake in his original or belated return for the assessment year 2026-27 by filing a revised return by March 31, thereby enabling correction of inadvertent errors within the legal framework.

The Last Resort: Filing a Revised Return (ITR-U)

If nothing happens by the July 31 deadline and the December 31 late filing window, the law offers a long-term fix called an Updated Return (ITR-U). It has been launched to encourage voluntary compliance and provides the taxpayers a generous window of up to 48 months (4 years) from the end of the relevant assessment year to file their details. It is optional and can generally be filed whether you previously filed an original, belated or revised return for that year.

Critical Limitations of the Revised Return Route

The four-year window for an ITR-U offers a lot of relief but it does come with some strict limitations that taxpayers should know about. You can’t use an amended return to get a bigger refund, to reduce a tax bill you already owe, or to carry forward losses you didn’t claim on earlier returns. Also, unlike original or belated returns, which can be revised under any circumstances, there is no scope for revising an ITR-U, once it is filed. Therefore, filing the ITR-U with 100% accuracy is necessary.
