Why more Indians prefer the O-1 visa over H-1B?

The O-1 visa is proving to be the preferred mode of living and working in America for talented Indians. The visa is reserved for individuals who have demonstrated exceptional ability in a field of endeavor, like technology, science, education, business, sports, arts, or entertainment. It provides foreign experts with the opportunity to work in the United States without resorting to the lottery process adopted in other visas, such as the H-1B.

One of the primary reasons why Indians are currently interested in the O-1 visa is that it has no annual quota. The H-1B visa, through which many professionals apply, is capped and selected by a random lottery. Even very well-qualified individuals will not be chosen. The O-1 visa sidesteps that problem. It also enjoys a higher success rate and can be processed more quickly, particularly if premium processing is applied.

To obtain an O-1 visa, the individual will need to show that they are among the top in their profession. Examples of this include winning awards, having research published, being the subject of media, or having a higher salary than others in the same profession. Although this may seem challenging, it is actually possible for many skilled professionals who have worked diligently and established a strong professional career. You don’t have to be a celebrity or globally famous. The key is to show real achievements that stand out in your profession.

This visa is supported by a U.S. employer or agent. That is, you must have a job offer or some sort of agreement with a company or institution in the U.S. The employer submits the application on your behalf. Once approved, the visa permits you to reside in the U.S. for a maximum of three years, with further extension possible.

Another reason why the O-1 visa is becoming increasingly popular is that it has the potential to give way to a green card. Most individuals who enter on the O-1 visa eventually apply for permanent residence in the EB-1A category, which also calls for evidence of extraordinary ability. As both categories have identical regulations, possession of the O-1 visa will simplify the green card process.

Briefly, the O-1 visa is an excellent choice for talented and qualified Indians who wish to work in the U.S. It is more flexible, quicker to process, and has fewer obstacles than conventional visa routes. Through proper preparation, a lot of professionals can be able to use this pathway.
